Making a settlement address declaration is a mandatory declaration regulated in Article 50 of the Population Services Law No. 5490. Notification in temporary accommodation is carried out in accordance with the provisions of the Identity Reporting Law No. 1774, and is carried out by businesses providing temporary accommodation services within the framework of the declarations of individuals. Making a notification contrary to the procedure stipulated in the Law No. 1774 or not making the notification at all is subject to administrative sanctions. Identity reporting services have been provided to general law enforcement units by businesses through online systems for a long time and are audited by law enforcement units.
It is seen that the apartments or residences used as described above are also used for services such as dormitories and hostels for students. Dormitories or hostels are subject to the provisions of the Regulation on Business and Working Licenses, which came into force by being published in the Official Gazette dated 10/08/2005 and numbered 25902. It is clear that they are in the nature of workplaces and that they cannot be employed without obtaining a business and working license duly from the authorized administrations. It is necessary to act in accordance with the aforementioned legislation about such places used as dormitories and hostels.
The following measures will be implemented in order to eliminate the security gaps in these places, which constitute an important risk area in terms of general security, to increase the efficiency in the fight against crime and criminals, to solve the problems experienced in practice, and to take legal, administrative and financial measures:
Inspections will be focused on places such as apartments, residences or apartments in the form of dormitories and hostels that are rented out for the day. The determinations made about the specified apartments and residences and their operators or owners will be reported to the responsible institutions without delay, depending on their interest.
In case of detection of violations of the legislation, necessary actions will be taken within the framework of the relevant legislation without violating personal rights and freedoms.

It is clear that apartments, residences and similar places used for daily stays are subject to the provisions of the Identity Declaration Law No. 1774. According to the provisions of the Regulation on the Implementation of the Identity Reporting Law, which was published in the Official Gazette dated 13/07/1974 and numbered 14944 with this Law, the accommodation operators keep the identity information of the accommodation and the records of arrival and departure from the facility in accordance with the sample and procedure, and It is responsible for keeping the general law enforcement officers ready for their examination at any time. Administrative fines will be imposed on those who violate this law in accordance with Article 15 of the same Law.

I kindly request and request that the subject be followed meticulously by the relevant authorities, especially the Civil Administrative Supervisors, that the procedures regarding the daily rented places by the authorized administrations are carried out in accordance with the above-mentioned procedures and principles, and that our Ministry is informed of the result of the implementation.

How to get a daily rental house license?

According to the legal regulations about daily rental houses, daily rental houses must be taken into hostel status and a license must be obtained for these houses.

With this regulation, which prevents tax loss, all businesses rented daily are included in the identification system as temporary residences.

With the registration of the daily houses with the hostel license, the identity information of the customers staying will be reported to the security. Until the law changes, hostels will report the identity information of their customers staying every night to the police station they are connected to. PENALTY FOR NOT GETTING LICENSE 

1,275 Police Stations across the country will strictly monitor rental homes in their area of responsibility. The police will direct homeowners to municipalities to issue licenses.

Despite the warning, daily rental houses that continue to provide hostel services without obtaining a license will be temporarily sealed with the decision of the local authority. An administrative fine of 183 TL will be imposed on the homeowners for the crime of "contrary to the order" of the Misdemeanor Law.

 

IDENTIFICATION REQUIREMENT

With the decision of the Council of Ministers, the Temporary Residence Places Identification System (GIYKIMBİL), which is applied to businesses providing accommodation services with 30 beds or more, will be changed to include daily homes. All businesses providing hostel services will be included in the GIYKIMBİL system.

Until the law changes, hostels will report the identity information of their customers staying every night to the Police Headquarters.

  1. Daily rental houses have taken the status of hostel and in order to get a hostel license;
